Our influencers chose the music, not us. Are we still exposed?
Frequently, yes. Rights holders have pursued brands over content posted by paid creators. Where a brand commissioned, briefed or paid for a post, that post is generally treated as brand marketing regardless of who pressed publish.
What about music playing at a show or festival we're filming?
It is in scope. A runway soundtrack, a festival set, a DJ at a launch party or the playlist in your own store is licensed for that room, not for your social channel — the moment it is captured in a Reel, you have published it. We flag the audio nobody on your team selected alongside the tracks that were chosen deliberately.
We use the in-app commercial library for everything. Isn't that enough?
It covers you on that platform, for that account type, at that moment. It does not survive a cross-post to another platform, it does not cover a creator posting from a personal account, and libraries change — a track cleared last season may not be cleared now.
Does runway and event footage count?
Yes, and it is a common gap. Music played in a venue is captured in the recording. A show reel posted to your channel contains that recording whether or not anyone on your team chose the track.
How far back does the risk actually go?
Claims are typically brought on content that is still published. Archives from previous campaigns — and previous agencies — remain live on your profile and remain in scope, which is why we audit back to your first upload rather than sampling recent posts.
